Fatal Motorcycle Accidents, Though Preventable, Are on the Rise in Florida

Fatal motorcycle accidents continue to mount in Florida, outpacing deadly crashes involving other vehicles. Fatalities on bikes in 2018 were more than double those in 2001, the year after Florida repealed its original mandatory helmet law. Although a new law has been put in place, it is far less restrictive and has not served to reduce the accident rate.

While the pre-2001 law required all motorcycle drivers and riders in Florida to wear helmets, the replacement legislation enacted in 2010 makes several exceptions. A person over 21 who is covered by an insurance policy providing for at least $10,000 in medical benefits may operate or ride a motorcycle without a helmet. Eye protection is still required. The law also does not apply to a person who is 16 years of age or older who is driving or riding a motorcycle that meets specific engine requirements and is not capable of driving over 30 miles per hour.

Wearing a helmet is one of the best ways to prevent a motorcycle accident from becoming fatal. According to the National Highway Traffic Safety Administration, helmets saved 174 lives in Florida in 2017. If all motorcyclists that year had worn helmets, 110 more lives could have been saved. Other causes for motorcycle fatalities cited by the NHTSA were impaired driving and speeding.

Although these safety measures can be life-saving, even the most careful riders can suffer bodily injuries that require compensation. Medical bills and rehabilitation expenses can cost thousands of dollars and riders may be out of work for several months or years. Motorcyclists should obtain comprehensive insurance and review their coverage periodically. Insurance is needed not only for out-of-pocket costs where there is no other vehicle involved in the crash but also to indemnify the motorcyclist if found at fault for causing an accident.
